WARNING: Cancer and Reproductive Harm


Why am I seeing this warning?

Proposition 65 (Prop 65) is a California law that requires the state to keep a list of chemicals that the State of California has identified may cause cancer or reproductive toxicity. If a product contains a chemical on the list, the State of California requires companies doing business in California to provide a ‘reasonable warning’. This warning can be given in a variety of ways, such as labeling qualified consumer products, posting signs at workplaces and stores, or providing a link to the warning online.

If a Proposition 65 warning is posted, it means that the business issuing the warning knows that one or more listed chemicals is merely present in its product.

For chemicals that are listed as causing cancer, the “no significant risk level” is defined as the level of exposure that would result in not more than one excess case of cancer in 100,000 individuals exposed to the chemical over a 70-year lifetime. In other words, a person exposed to the chemical at the “no significant risk level” for 70 years would not have more than a “one in 100,000” chance of developing cancer as a result of that exposure.

For chemicals that are listed as causing birth defects or reproductive harm, the “no observable effect level” is determined by identifying the level of exposure that has been shown to not pose any harm to humans or laboratory animals. Proposition 65 then requires this “no observable effect level” to be divided by 1,000 in order to provide an ample margin of safety. Businesses subject to Proposition 65 are required to provide a warning if they cause exposures to chemicals listed as causing birth defects or reproductive harm that exceed 1/1000th of the “no observable effect level.”

The purpose of Proposition 65 is simply to notify consumers that the product they are purchasing may have a chemical flagged by California Prop 65 present in its makeup. A Proposition 65 warning does not necessarily mean a product is unsafe or in violation of any product-safety standards or requirements.

In order for Hot Tub Works to be in compliance with California Prop 65 regulations, we are required to place the California Prop 65 Warning on each product page with products that may contain one of the chemicals listed. The wording, specified by California law, is: “CA Prop 65 Warning: This product contains chemicals known to the state of California to cause cancer and birth defects or other reproductive harm.”

Hot Tub Works believes our products are safe when used as intended. However, in order to be compliant with California law, Hot Tub Works, along with many major manufacturers in industries ranging from sleepwear to electronics and food products to pool supplies, has decided to place the CA Prop 65 Warnings on the product pages with qualifying products that are being shipped to California or have a likelihood of being shipped to California.
